Actor singer Gordon MacRae, best remembered as the singing cowboy Curly in died yesterday. He was 64. He had been hospitalized at Bryan Memorial Hospital in Lincoln since Nov. 27 for treatment of cancer of the mouth and jaw.

A hospital spokesman said his death, at 2:15 a.m., was "related to cancer." "He died very peacefully in his sleep," MacRae's wife, Elizabeth, said in a telephone interview. Mrs. MacRae said that although her husband suffered a stroke in 1982 and doctors said he would never be able to work again, he kept performing "out of sheer guts and willpower." A memorial service is scheduled Monday in Lincoln. A private burial is planned. The family asked that memorials be sent to the National Council on Alcoholism.

Since undergoing treatment for alcoholism in 1978, MacRae had spoken out on the disease and was honorary chairman of the National Council of Alcoholism. MacRae's long career reached its peak on the screen in the mid-1950s with the musicals in which he played the cowboy Curly, and "Carousel." He fought a long battle against alcoholism, and once said that he had been so drunk during a concert in Greenville, S.C., that couldn't remember any song lyrics. "I think I'll always have a special place in my heart for Greenville because it was there that I finally came to my senses when I hit rock bottom," MacRae said when he returned to the city in 1983, for a concert sponsored by the North Greenville Alcoholism Treatment Program. "You don't realize what's going on until you admit you are powerless over this creeping, cunning, dastardly powerful disease and that your life is unmanageable," MacRae: said. During the last year, cancer prevented him from performing, Mrs.

MacRae said. "His last days were really spent trying to overcome this," she said. "Gordon was a very religious man and he spent most of his time in prayer." Doris Day, who starred with MacRae in five films, said in Los Angeles that "he was so adorable and I loved him so. "I spoke to him not long ago, and he said, 'Clara (his pet name for Miss Day), I'm going to beat And, I thought he would," Miss Day said. "His voice was magnificent, and no one sang like him.

We had so much fun when we made films together, and our favorites were 'On Moonlight Bay' and 'By the Light of the Silvery the actress said. MacRae was born March 21, 1921, in East Orange, N.J. His screen credits include, "The Big Punch," 1948; "Look for the Silver Lining," 1949; "Backfire," 1949, and "Return of the Frontiersman," 1950. He was also in "Tea for Two," 1950; "West Point Story" 1951; "Oklahoma!" 1955; "Carousel," 1956, and "The Best Things in Life are Free," 1956. In the late 1950s, he moved into television as host of the "Colgate Comedy Hour" and the "Lux Television Theater." He also had a ing contract with Capitol Records.

MacRae and his first wife, Shella Stephens, had four children Meredith, Heather, W. Gordon and Bruce before they were divorced. MacRae married Elizabeth Lambert Schrafft, a Nebraska native, in 1967. They had daughter, Amanda, born in 1968. The couple adopted Lincoln as their summer home in 1971, saying that neither New York nor Los Angeles was a proper place to raise a baby.

They lived in Lincoln yearround after MacRae suffered the stroke. Longtime WHAS organist Herbie Koch dies Herbie Koch, who serenaded the Louisville area with his organ music on WHAS Radio and TV from 1933 to 1956, died Wednesday at St. Joseph Hospital in Phoenix, Ariz. He had lived in retirement at Sun City, since 1973. Koch's wife, Mary, said he had undergone an operation to replace a heart valve about three weeks ago.

She said his recovery was going well until he suffered a blood clot. Koch broke into professional music as 14-year-old substitute the organist at the old Walnut Theater, al which was on the site now occupied by the Kentucky Towers apartments, during World War I. He later played at the old Rialto and then got a job with Paramount Pictures, playing the circuit in the chain's theaters across the country. He shared billings with a number of early stars of vaudeville, radio, the stage and movies; his touring took him to such places as New York, Buffalo, Chicago, New Denver and England. He was playing nightly at Paramount's Dominion Theater in London in the early 1930s when Paramount decided to disband its troupe of organists.

Attorneys in the theft and official misconduct trial of state Treasurer Frances Jones Mills went through the tedious task yesterday of drafting instructions for the jury. Closing arguments are tentatively scheduled for Monday if Franklin Circuit Judge William Graham rejects defense motions to issue directed verdicts of acquittal for Mills six of her current or former employees. Graham denied similar motions on 60 of the 62 charges in the case two weeks ago, when the prosecution finished presenting its evidence.

The last of the defendants rested their cases Thursday, and Assistant Attorney General Thomas Wine did not call any rebuttal witnesses. Ms. Mills faces 10 felony counts of theft by deception and 15 misdemeanor charges. The defendants are charged with performing campaign work on state time or ordering others to do so. All have pleaded not guilty.

The violations allegedly occurred in 1983 when Ms. Mills was secretary of state and was running for treasurer. Instructions to the jury include legal definitions of the charges involved and how the jury should interpret them, plus the jury's options on returning a verdict. Elizabethtown judge gets circuit court post Associated Press FRANKFORT, Ky. Hugh Roark has been appointed Hardin Circuit Court judge by executive order of Martha Layne Collins. Roark, a district judge in Elizabethtown, succeeds Michael Coyle, who resigned last month, the governor's press office said yesterday. Phil Miller, a spokesman for the governor, said Roark was appointed Thursday. When Koch returned to Louisville to visit his parents, he met with the station manager, who gave him a job "on a handshake." His late-night show, "The Dream Serenade," ran more than 5,000 nights. A Louisville policeman once told Koch his music filled Cherokee Park every night, coming from the radios of parked cars there. Koch shared his spot on the show at different times with WHAS announcers Jim Walton, Milton Metz and Foster Brooks. Koch left WHAS in 1956 to teach organ at a local music store. About the same time, he started on a new career as a carillonneur, playing the carillon at Liberty National Bank Trust main office on Jefferson Street.

After that, he was guest carillonneur at the Seattle and New York world's fairs and at the Montreal Expo. At the 1964 New York World's Fair, Koch played the Coca-Cola carillon, which was later moved permanently to Georgia's Stone Mountain Park. Koch left Louisville in 1966 to become carillonneur and music director at the park, where he stayed for seven years. He was named Georgia's official carillonneur by then- Gov. Jimmy Carter.

He was a member of United Church of Sun City, Sun City Masonic Lodge, Sundial High Twelve Club, American Federation of Musicians and American Society of Composers and Authors. Survivors besides his wife include a daughter, Mary Lou Harned of Greensboro, N. seven grandchildren; four great-grandchildren. The body will be cremated. A memorial service will be held at 3 p.m.

Man gets night in jail, fine over protest Associated Press HENDERSON, Ky. Environmental activist John Blair spent a night in jail after pleading guilty to of disrupting the groundbreaking for Union Carbide $10 million PCB-removal plant. About 30 members of the Henderson-based Citizens for Healthy Progress held a candlelight vigil outside the Henderson County Detention Center Thursday night to support Blair. The 39-year-old commercial photographer was charged with disorderly conduct after taking eight gold-painted shovels during the ceremony Dec. 19 at the Henderson County Riverport.

He also was fined $150 and ordered to pay $67 in court costs, and was placed on one year's probation. After sentencing Wednesday, Blair told reporters, "I don't know of any polluter who's ever gone to jail for polluting the environment of Kentucky." Blair is president of Valley Watch, an Evansville, environmental group. He will be released in time to attend an auction tonight to raise money for legal fees. Meanwhile, Jane McConathy, president of Citizens for Healthy Progress, said her group will file suit today against Union Carbide, the state Natural Resources and Environmental Protection Cabinet and the attorney general's office. The suit is an attempt to block operation of the Carbide plant, which is under construction, she said.

Franklin Mayor Larry Freas has been fined $371 and will lose his driver's license for 30 days after pleading guilty to a charge of drunken driving. Freas was arrested by state police in Bowling Green on Jan. 2.

He was released from Warren County Jail the next morning after posting a $417 bond. and Mike Bernard, doing business as Green River Ford Mercury, were cited by the commission Dec. 11 for allowing Steve Sutton to drive a Ford van bearing their dealer tag. Sutton, a UK student, is the son of Eddie Sutton, the University of Kentucky's head basketball coach. The consent decree is subject to approval by the commission, which will meet Feb.

(AP) The bandits who took six of Danny Green's beehives should hope the weather stays cold, says sheriff's Deputy Steven Golden. Green, 35, discovered the hives missing from a rural Hendricks County farm Thursday when he checked on them. The hives, containing an undetermined number of bees, were valued at about $720.
